In these Terms, "we", "us", "our" and "RankUP Marine" mean RankUP Marine Digital Solutions OPC. "You" means the individual using the platform.
These Terms are an agreement between you and RankUP Marine Digital Solutions OPC. By creating an account or using the platform, you agree to them. If you do not agree, do not use the platform.
2. What RankUP Marine is
RankUP Marine is a professional learning platform for marine engineers.
It provides structured study material, knowledge reinforcement, and interactive engine-room simulation to help engineers build, maintain, and refresh competency across their rank progression, from Engine Cadet through Chief Engineer.
Some material is presented in question-and-answer, quiz, or scenario-assessment format. This is a study and self-check aid. It does not constitute an examination, an assessment of competency, or any form of official evaluation.
RankUP Marine is educational material. It is not operational instruction, and it is not a certification. Section 8 sets out the full scope of this and forms an essential part of these Terms.
3. Eligibility
The platform is intended for use by persons aged 18 years and over. By creating an account you confirm that you are at least 18 years old.
The platform is not directed at children, and we do not knowingly collect personal information from anyone under 18. If we become aware that an account belongs to a person under 18, we may suspend or close that account and delete the associated personal information.
4. Your account
- You must provide accurate registration information and keep it current.
- An account is personal to one individual. You may not share, lend, sell, or transfer your login credentials, and you may not allow another person to access the platform through your account.
- You are responsible for keeping your password confidential and for all activity that occurs under your account.
- Tell us promptly at the contact address above if you believe your account has been accessed without your authorisation.
Access to content is governed by the subscription tier attached to your account. Certain content, features, and administrative functions are reserved and are not part of any subscription offering.
5. Acceptable use
You agree not to:
- copy, reproduce, republish, distribute, or publicly display platform content outside your own personal study use;
- download, scrape, harvest, or extract content in bulk, whether manually or by automated means;
- resell, sublicense, or otherwise commercially exploit the platform or its content, including using it to deliver training to third parties;
- reverse engineer, decompile, or attempt to derive the source code of any part of the platform;
- circumvent, disable, or attempt to bypass any access control, subscription tier restriction, or security measure;
- upload or submit any content that is unlawful, that infringes another party's rights, or that you are not permitted to disclose, including confidential company documents, vessel-specific safety management material, or another person's personal information;
- use the platform in any way that interferes with its operation or with other users' use of it.
We may suspend or terminate access for breach of this section.
6. Intellectual property
All content on the platform, including written material, curricula, simulations, diagrams, questions, and software, is owned by RankUP Marine Digital Solutions OPC or licensed to it, and is protected by Philippine and international intellectual property law.
Subject to these Terms and to your subscription remaining in good standing, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content for your own study and professional development. No other rights are granted.
RANKUP MARINE® is a registered trademark of Reyndell Valdez (IPOPHL Reg. No. 4/2026/00518344), used under authorization by RankUP Marine Digital Solutions OPC. You may not use the mark and any associated names and logos without prior written permission.
Equipment, machinery, and systems depicted in simulations are generic and fictional, created for training purposes. Any resemblance in naming, specification, or appearance to a real manufacturer's product is incidental and does not imply any relationship with, endorsement by, or approval from that manufacturer.
7. Plans, payment, and access periods
This section applies when you purchase a paid plan. If you use only the free tier, Sections 1 to 6 and 8 to 16 apply to you.
7.1 Plans and pricing. Paid plans, the ranks each plan covers, and the price of each plan are shown to you before you pay. Prices are stated in Philippine Pesos and include applicable taxes unless stated otherwise. Where a plan is offered through an app store, the store shows its own price and terms.
7.2 Pay per period; no automatic renewal. A plan purchased from us directly pays for one access period — one month or twelve months, as shown at checkout — starting when your payment is confirmed. Your payment details are not saved for future charges and your plan does not renew by itself. When your period ends, paid access ends and the free tier remains available to you. A purchase made through an app store follows that store's own renewal and cancellation rules.
7.3 Renewing. You may buy a further period of your current plan at any time before it ends. The new period is added to the end of your current one, so renewing early never costs you paid time. One paid plan is active per account at a time; a different plan can be purchased once your current period ends.
7.4 Confirmation and reminders. We email you a payment confirmation when your payment is applied, and reminders 7 days before, 1 day before, and on the day your access period ends. These go to the email address on your account, so keep it current. The payment confirmation is not an official receipt.
7.5 Refunds. A paid period is not refundable once it has started, except: (a) where we charged you in error or more than once, in which case we refund the excess; (b) where the paid service was unavailable for a material part of your period through our fault, in which case we refund or extend your access proportionately; and (c) where a refund is required by law. We may also grant a refund at our discretion in other cases. To request a refund, write to support@rankupmarine.com with your payment reference. Refunds are made to the payment method you used. For a purchase made through an app store, refunds are handled by the store under its policy.
7.6 Reversed payments. If a payment is reversed, disputed, or charged back after access was granted, we may withdraw the access that payment paid for.
7.7 Price changes. We may change plan prices at any time. A change never affects a period you have already paid for; the price shown at checkout is the price you pay.
7.8 Payment processing. Payments made to us directly are processed by a third-party payment provider (currently HitPay). Your card or e-wallet details are entered on the provider's secure checkout page and never reach our servers. Your use of that checkout is also subject to the provider's own terms.
8. Educational purpose and limitation of reliance
This section is fundamental to your use of the platform. Read it carefully.
RankUP Marine is provided for education, training, and self-study only.
8.1 Not operational guidance. Content on this platform, including simulations, procedures, checklists, worked examples, scenarios, and specifications, is illustrative and generic. It does not describe your vessel. It must never be used in place of:
- your vessel's Safety Management System;
- your company's standing orders and procedures;
- equipment makers' instruction manuals;
- Classification Society rules;
- flag-State or port-State requirements; or
- the professional judgement of a qualified officer.
Where this platform differs from any of those sources, those sources govern and this platform does not.
8.2 Not a certification or accredited training. Use of RankUP Marine does not confer any certificate of competency, endorsement, licence, qualification, sea-service credit, or STCW training credit. It is not an approved or accredited training course, and it does not replace any mandatory hands-on training, practical assessment, or approved course required for certification.
8.3 Not affiliated or endorsed. RankUP Marine is independent. It is not affiliated with, approved by, or endorsed by MARINA, the IMO, any flag Administration, any Classification Society, any examining or licensing body, any maritime training centre, any shipping company, or any equipment manufacturer.
8.4 Automatically generated content. Certain features, including C/E PoyPoy, generate responses automatically using AI. Automatically generated content may be incomplete, out of date, or incorrect. Verify anything safety-critical against a primary source before relying on it. Risk assessments and root cause analyses produced by these features are reference material to help you prepare your own work; they are not a substitute for your company's safety management system, risk assessment, permit-to-work, or incident investigation procedures, and they must not be relied on as the assessment of record. Do not submit confidential, company-proprietary, or vessel-specific safety material to any AI feature.
8.5 Accuracy and currency. We take care to keep regulatory and technical content accurate and current, but regulations change and errors are possible. We do not warrant that content is complete, current, or free from error.
8.6 Your responsibility. You are responsible for how you apply anything learned here. Safety-critical decisions on board remain the responsibility of the vessel, the Master, the Chief Engineer, and the officer in charge, in accordance with the vessel's own Safety Management System and applicable law.
9. Availability and changes to the platform
We aim to keep the platform available but do not guarantee uninterrupted or error-free access. Access may be interrupted for maintenance, updates, or reasons beyond our control, including internet or satellite connectivity at sea.
We may add, modify, or discontinue features. If we discontinue a feature that formed a material part of your paid subscription, you may cancel and we will refund the unused portion of your current period.
10. Limitation of liability
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Philippine law, including liability for death or personal injury caused by our negligence, or for fraud or wilful misconduct.
Subject to that:
- We are not liable for indirect, incidental, special, or consequential loss, or for loss of profit, revenue, opportunity, employment, certification, or reputation.
- We are not liable for any loss, damage, injury, casualty, pollution incident, detention, deficiency, or claim arising from your use of platform content as operational guidance, contrary to Section 8.
- Our total aggregate liability to you for all claims arising out of or connected with these Terms or your use of the platform is limited to the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold harmless RankUP Marine Digital Solutions OPC and its officers from any claim, loss, or expense arising from your breach of these Terms, your misuse of the platform, or your unauthorised sharing or redistribution of platform content.
12. Suspension and termination
We may suspend or terminate your account, with notice where practicable, if you breach these Terms, if a payment is reversed or charged back, or if we are required to do so by law. You may close your account at any time.
On termination, your licence under Section 6 ends immediately. Sections 6, 8, 10, 11, 14, and 15 survive termination.
13. Complaints and redress
If you have a complaint about the platform, a transaction, or the service you have received, contact us at support@rankupmarine.com.
We will acknowledge your complaint within 15 calendar days and aim to resolve it within 30 days.
If your complaint is not resolved to your satisfaction, you may refer it to the Department of Trade and Industry or the appropriate government agency having jurisdiction over internet transactions in the Philippines.
14. Changes to these Terms
We may update these Terms. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect. Continuing to use the platform after the effective date means you accept the updated Terms. If you do not accept them, you may close your account.
15. Governing law and venue
These Terms are governed by the laws of the Republic of the Philippines. Any dispute shall be brought before the courts of Cauayan City, Isabela, to the exclusion of any other venue, without prejudice to any right you have to bring a complaint before a government agency.
16. Entire agreement and severability
These Terms, together with the Privacy Policy, form the entire agreement between you and RankUP Marine Digital Solutions OPC regarding the platform. If any provision is held unenforceable, the remaining provisions remain in full force.
